Welcome to 317 Movement! We are proud to be a movement space rooted in community, discipline, and creativity. Our mission is to create an empowering environment for people of all levels to explore Capoeira, fitness, and holistic wellness. By participating in our classes and programs, you agree to the policies outlined below to help ensure a safe, respectful, and positive experience for all.

GENERAL STUDIO POLICIES:

  • Children: Children are only permitted in designated Capoeira Kids classes. We ask that parents do not bring children into adult or fitness-only classes for safety and space considerations.

  • Respect for the Community: 317 Movement is a shared space. We expect all participants to be respectful, arrive on time, and treat others with kindness.

    PRIVACY POLICY:

    317 Movement is committed to protecting your privacy. This section outlines what personal information we collect, how it is used, and how we safeguard it.

    Information Collection, Use & Sharing

    We collect personal information such as names, phone numbers, email addresses, and payment details when you register, book classes, or contact us.

    • We do not sell or rent your information to any third parties.

    • We use your data to provide and improve our services, communicate with you, and process transactions.

    • We may use your contact information to notify you about class updates, upcoming events, schedule changes, or policy updates—unless you opt out.

    Account Responsibility:

    You are responsible for maintaining the confidentiality of your account and password. Any activity that occurs under your account is your responsibility. Please log out after using a shared computer.

    CLASS PURCHASES:

    • Single Classes & Class Packs are non-refundable and non-transferable. Please review expiration dates before purchasing.

    • Unlimited Memberships grant access to all Capoeira and fitness classes within the billing cycle. Late cancellations and no-shows may result in penalties (see below).

    ARRIVAL & LATE POLICY:

    We value accountability and consistency!

    • We ask that all participants arrive early enough to prepare and check in.

    • For Capoeira and fitness classes, you may not join class more than 10 minutes late. After 10 minutes, you will not be permitted to enter to ensure proper warm-up and avoid disruption.

    • Please arrive 15 minutes early if you are new or need assistance (e.g., equipment setup).

    CLASS CANCELLATION POLICY:

    • You must cancel your class at least 12 hours before the scheduled start time to avoid penalties.

    • For early morning classes (6:00 AM or 7:00 AM), cancellations must be made the night before.

    • Late cancellations or no-shows:

      • Class Pass holders: Forfeit one class credit

      • To cancel your membership, you must submit written notice at least 30 days in advance to:

      • No-Show Clause:
        If you do not attend class for consecutive months without formally canceling, you will continue to be charged membership dues.

        Exceptions may be granted for:

        Verified medical issues (doctor’s note required)

        Relocation (proof of address change required)

        317 Movement reserves the right to amend this policy with 30 days' notice to members.

      • By purchasing a monthly membership pass, the cardholder authorizes 317 Movement to charge the provided payment method every 30 days for recurring membership fees, as well as for any additional in-studio purchases made by the member—unless an alternate payment method is provided at the time of purchase.

        If a payment is declined, members will have a 3-day grace period to resolve the issue. After this period, the membership will be temporarily frozen until payment is received.

        Please note:

        • Monthly passes are non-transferable and may not be used to book or share with guests.

        • Memberships automatically renew unless canceled according to our cancellation policy.

    WAITLIST POLICY:

    • If a class is full, you can join the waitlist. You will be notified via email or text if you're added into the class.

    • If you’re added into a class and do not show, it will count as a late cancellation.

    • If you’re on multiple waitlists, be sure to cancel any class you can’t attend to avoid charges.

    Dismissal & Termination:

    317 Movement reserves the right to:

    Dismiss any participant (or child participant) who fails to adhere to expectations or policies.

    Terminate this agreement for any reason, including conduct contrary to our values.

    This agreement is non-transferable by the client but may be assigned by 317 Movement to a related entity.

    RETURN AND EXCHANGE POLICY

    Classes, class packages, and event tickets are non-refundable and non-transferable unless otherwise expressed by 317 Movement.

    Acknowledgment of Health and Risk:
    Due to the presence of communicable diseases (e.g., COVID-19, Influenza), you affirm that you are in good health, not experiencing symptoms, and not at increased risk due to exposure. You agree to refrain from participating if you feel unwell or unsure about your health. Consult your physician if needed.
    317 Movement is not a medical provider and cannot diagnose health conditions. You agree to promptly disclose any injury or condition that may affect your/your child's ability to train safely. The trainer's decision to discontinue training for health and safety reasons shall be final.

    Positive Training Environment:
    We foster a positive, respectful, and inclusive space. You voluntarily agree to uphold this standard at all classes and events. Harassment, discrimination, or offensive behavior will result in immediate dismissal from the event or studio, with no refund, at the discretion of Professor Caxixi / Harly Materan, Instructor Tempestade / Jessica Materan

    This applies to all settings, including:

    In-person classes

    Online platforms

    Off-site events and social gatherings

    Examples of harassment include, but are not limited to:

    Verbal abuse or threats

    Offensive or sexualized comments or images

    Intimidation or stalking

    Inappropriate physical contact or sexual attention

    Demeaning comments based on appearance, race, gender, etc.

    We are committed to creating a safe space for all, regardless of race, gender identity, age, sexual orientation, disability, religion, or background.

    Photography & Media Release:
    Participant grants permission to 317 Movement to use photos, videos, or recordings of the Participant in any promotional or marketing material, including but not limited to social media, websites, newsletters, and print advertisements. No compensation will be provided. All such media is considered the property of 317 Movement. This includes images of your child if you are signing on their behalf.

    RELEASE AND INDEMNITY AGREEMENT:

    This Release and Indemnity Agreement (“Release”) is made to release and indemnify 317 Movement, an Indiana-based organization, and all of its respective owners, instructors, employees, agents, contractors, volunteers, successors, and assigns (collectively referred to as the “Released Parties”).

    The undersigned, on their own behalf or, if applicable, as the parent or legal guardian of a minor (the individual participating in any activity, class, or service offered by 317 Movement shall be referred to hereafter as the “Participant”), and on behalf of the undersigned’s heirs, successors, representatives, and assigns (singularly and collectively referred to as the “Releasing Parties”), hereby grants this full release and indemnification as consideration in exchange for allowing the Participant to take part in any class, private training, workshop, massage, event, or other activity associated with or provided by the Released Parties.

    Acknowledgment of Risk and Voluntary Participation:

    Participant acknowledges that they are participating voluntarily after having the opportunity to observe the studio space, learn about the instructors’ qualifications, and ask questions regarding the services and any risks involved.

    Participant understands that participation in Capoeira, fitness training, Strength Flow, HIIT, yoga, and other physical activities may involve inherent physical risks, including but not limited to:

    • Muscle tears or strains

    • Sprains

    • Fractures

    • Concussions

    • Dehydration

    • Dizziness or fainting

    • Loss of balance

    • Physical exhaustion or strain

    • Injury due to physical contact

    • Even the risk of death

    If participating in Capoeira, the Participant acknowledges that Capoeira is a martial art that involves full-body movement, acrobatics, kicks, and partner interaction. While instructors will ensure safety to the best of their ability, the Participant understands that physical contact—though not intentional—can occur during class, drills, games (rodas), or partnered exercises.

    By participating, the Participant fully accepts and assumes all known and unknown risks, including those that may arise from interaction with other participants or from the physical nature of martial arts training.

    Release of Claims:

    Despite all known and unknown risks, the Releasing Parties hereby waive, release, and discharge any and all claims, demands, causes of action, damages, liabilities, and expenses (including legal fees) they may have against the Released Parties arising from or related to the Participant’s involvement in any class, program, or use of 317 Movement’s facilities or equipment. This includes claims arising from alleged negligence, omissions, or misconduct of the Released Parties.

    Medical Disclaimer:

    Participant acknowledges that they should consult a physician before engaging in any physical activity, especially if they have or develop a condition such as (but not limited to): asthma, heart issues, high blood pressure, stroke, lupus, hernia, dizziness, loss of balance, recent surgery or concussion, orthopedic concerns, or if currently pregnant. Participation in any class or service is done at the Participant’s own risk.

    Indemnification:

    The Releasing Parties agree to indemnify, defend, and hold harmless the Released Parties from any and all claims or liabilities, including legal fees and costs, arising from the Participant’s involvement in any 317 Movement activity or service, including the use of studio equipment, or attendance at off-site events hosted by 317 Movement.

    Personal Property:

    Participant understands that all personal belongings brought to the studio or event space are the Participant’s sole responsibility. The Released Parties are not liable for any lost, stolen, or damaged property while on the premises of 317 Movement or any other location used by the studio.

    Credit Card Authorization & Confidentiality:

    Participant agrees to keep a valid credit or debit card on file for payment of memberships, services, or retail purchases. This card will remain on file until updated or canceled by the Participant. 317 Movement agrees to protect all personal and billing information in compliance with standard privacy and security practices. Information will not be shared or used outside of studio business operations.

    Legal Jurisdiction & Severability:

    This Agreement shall be governed by the laws of the State of Indiana. If any portion of this Release is found to be invalid or unenforceable, all remaining sections shall remain in full force and effect. Any dispute arising under this Agreement shall be resolved through binding arbitration in the State of Indiana.

    BY SIGNING OR ACCEPTING THIS AGREEMENT ELECTRONICALLY OR IN PERSON, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND VOLUNTARILY AGREE TO THE TERMS OF THIS RELEASE AND INDEMNITY AGREEMENT.
